Photolab “Looks Like Canada Contest”
OFFICIAL CONTEST RULES


1. Contest Sponsor: Loblaws Supermarkets Limited, 6220A Yonge Street, North York, Ontario M2M 3X4.

2. No purchase is necessary.

3. Official Contest entry forms and Contest rules are available by clicking and linking to the Contest promotion at the Loblaws website, www.loblaws.ca. Contest rules can also be obtained at participating Loblaws stores in Ontario or by sending a self-addressed stamped envelope to the Contest Sponsor at the address above.

4. To enter on line, complete the official entry form located at www.loblaws.ca and submit your one Photograph submission for the Contest along with an essay (under 25 words) describing why your Photograph represents your view of Canada. Photos must be in a .jpg format with a minimum files size of 100KB and a maximum file size of 6MG . Online entries must be received between Saturday, April 24 at 12:01 a.m., and Friday, May 21, 2004 at 11:59 p.m. (ET). Limit one entry per e-mail address.

5. To enter the Contest by mail, send the following information by mail to Loblaws Supermarkets Limited, Photolab “Looks Like Canada Contest”, 6220A Yonge Street, North York, Ontario M2M 3X4: name, address and daytime telephone number, your one Photograph submission for the Contest along with an essay (under 25 words) describing why your Photograph represents your view of Canada. Mail entries must be postmarked by Friday, May 21, 2004, and received by Friday, May 28, 2004. For mail-in entries, only original Photographs will be accepted. Limit one entry per day per person. Each envelope must be mailed separately. Minimum size of Photograph submission is 4” X 6” and maximum size of Photograph submission is 8” X 10”

6. All Photographs submitted must be real existing images taken in Canada since on or after January 1, 2004. The entrant must be the photographer of the Photograph and the holder of all legal rights to the Photograph. Photographs must be originals and cannot be altered as to content nor otherwise adjusted except for simple editing such as cropping, brightness/darkness adjusting, red eye removal. Compositions, collages, photographs of photographs will not be considered. Photographs submitted cannot be submitted if being used in a professional capacity such as having been published, licensed to others, submitted to other organizations or contests or displayed in any manner as the purpose of the Contest is to obtain an “original” / “unique” winning Photograph. All entries become the property of the Contest Sponsor and will not be returned. Individuals can enter both on-line and by mail provided that the above noted limits are complied with, however failure to comply therewith may void all entries from that person or e-mail address.

7. In the event that the Photograph to be submitted includes an Identifiable Individual (or Individuals) then the entrant must obtain the written consent of such Identifiable Individual(s) to the submission of the Photograph in the Contest and a release by such Identifiable Individual(s) permitting the use of the Photograph by the Contest Sponsor in the event the entrant is the Winner as provided for in these Contest rules. In the event that the Identifiable Individual is not of the age of majority then the consent and release of the parent / guardian will be required. Such Consent(s) and Release(s) will be a condition of winning. Winner agrees to indemnify the Contest Sponsor in the event of any claim by an Identifiable Individual and Contest Sponsor assumes no liability in such regard.

8. There will be one prize available to be won. The “Prize” consists of a holiday for the Winner (and “Guest(s)”, if desired) to any Canadian destination being transportation and accommodation (subject to the maximum expenditure set out herein and the other provisions of these Rules). The maximum retail value of the prize is $2,500.00 (inclusive of all applicable taxes) dependent on choices of the Winner including, inclusion of Guest(s), destination, travel method, accommodation and duration. There are no substitutions and the Prize must be accepted as awarded and may not be sold or transferred and there is no cash value. There is no cash component in the event that the aggregate cost of the Prize holiday is less than $2,500.00

9. The Winner shall co-ordinate the Prize arrangements only through the Travel Agency designated by the Contest Sponsor. The Prize cannot be combined with any other travel arrangements. The Winner may not use the Prize as part of any travel, loyalty, mileage or other rewards program. It is advised that the Winner (and Guest(s)) obtain private travel insurance, at their own expense. The Winner may also desire to obtain travel cancellation insurance at his/her own expense at his/her discretion as travel arrangements may not be able to be changed once finalized and any cost of changes is personal to the Winner. Travel dates and accommodation are subject to change without notice or compensation. All components of the Prize are subject to availability. The holiday must be taken prior to March 31, 2005.

10. The Winner shall be personally responsible for any additional costs beyond that included in the Prize and may be required to pay for such costs in advance. Personal expenses of the Winner and any Guest(s) include, without limitation, meals and beverages (unless explicitly included in the travel or accommodation reservations), room service, tips and gratuities, gifts, souvenirs and other merchandise, telephone calls, car rentals, taxis and other local transportation, insurance and all costs to and from the point of departure and arrival for the travel.

11. The Winner is entitled to travel alone or invite a Guest or Guests, provided the maximum Prize value amount is not exceeded. The Winner shall be obligated as a condition of participation by his / her Guest(s) in the Prize holiday for such Guest(s) to obtain from each Guest (or in the event the Guest is under the age of majority then from his / her parent or guardian) a Release of the Contest Sponsor and the advertising and promotional agencies and the co-ordinating Travel Agency in a form satisfactory to the Contest Sponsor as it relates to their participation in the Prize holiday.

12. At approximately 2 p.m. on Monday, May 31, 2004, the Judging Committee will select a winning entry from all entries received by the dates and times indicated above. The “Judging Committee” will be comprised of employees of the Contest Sponsor to determine a potential Winner. All entries will be reviewed by the Judging Committee and a winning entry chosen based on subjective creative opinion. The decision of the Judging Committee is final. Contest Sponsor will contact the potential Winner by e-mail or telephone on or about Wednesday, June 2, 2004. If the potential Winner does not contact Contest Sponsor by 5 p.m. on Wednesday, June 9, 2004, or does not comply with the Contest requirements, that potential Winner will be deemed to have forfeited any rights to his or her Prize and Contest Sponsor will have the right to select an alternate potential Winner from among the remaining eligible entries and contact such person in the manner provided above. Before being declared the Winner, a selected entry must be verified by the Contest Sponsor. All entries submitted over the website will be deemed made by the person who completed the online entry form as shown by the name thereon.

13. The decisions of Contest Sponsor on all issues relating to the contest will be final and binding on all entrants. The Winner will have until July 30, 2004 to claim the Prize and until December 31, 2004 to book the Prize holiday and the holiday must be taken before March 31, 2005.

14. Chances of winning depend on the quality, originality and general feeling and impression of the Photograph and essay submission and the total number of eligible entries received and the opinion of the Judging Committee. Entries that are mutilated, forged, duplicated or obtained from unauthorized sources as determined by Contest Sponsor will be disqualified. Contest Sponsor assumes no responsibility for postage due, late, lost, stolen, delayed, illegible, incomplete, or misdirected entry forms, or human error, or technical malfunctions, including but not limited to inability to access the website, lost, delayed or incorrect data transmission, interruption or failure, other electronic malfunctions, computer or telephone hardware or software failures, malfunctions or garbled transmissions. Contest Sponsor is not responsible for any problems or technical malfunction of any telephone lines, computer online systems, servers, or providers, computer equipment, software, or injury or damage to entrant’s or any other person’s computer related to or resulting from participation in the Contest or downloading any materials in relation to the Contest. Any attempt by an entrant to deliberately interfere with or damage any website or undermine the legitimate operation of this Contest will result in disqualification. Any such action may be in violation of civil and criminal laws, and Contest Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

15. The Contest is open to all legal residents of Ontario who have reached the age of majority. Employees, officers, directors, representatives and agents of Contest Sponsor and the promotional agents or the co-ordinating Travel Agency, as well as those with whom such persons are domiciled, are not eligible. By entering, each entrant agrees to abide by the Contest rules and to the decisions of the Contest Sponsor which are final and binding in all respects. All entries become the property of the Contest Sponsor and none will be returned. No correspondence or communication will be entered into except with a potential Winner (except as provided in paragraphs 3 and 19 herein). Contest is subject to all applicable federal, provincial and municipal laws, and all applicable local, provincial, federal or other taxes, duties or fees are the sole responsibility of each winner and will be paid by the winner. Contest Sponsor reserves the right in its absolute discretion to modify or withdraw this Contest at any time, in whole or in part, without prior notification, for any reason.

16. The Contest Sponsor shall have the right at its option to publish the winner’s name or to use the winner’s name, address, photograph and/or video image for marketing and/or promotional purposes, without compensation, unless otherwise prohibited by law. Such right shall constitute an exclusive license for the Contest Sponsor to use the Photograph during the calendar year 2004 and thereafter shall be a non-exclusive license. Accordingly, the Winner shall not himself/herself nor permit any other party to in any way use the Photograph during the calendar year 2004.

17. None of Contest Sponsor, the advertising and promotional agencies or the co-ordinating Travel Agency or their respective agents, officers, directors, employees and representatives shall be responsible in any way for the use of or bear any liability whatsoever in any way attributable to an entrant’s participation in this Contest or the Prize awarded in this Contest, including liability for any injury, loss or damages of any kind to persons, including death, and property. Prior to delivery of his/her Prize, and in any event no later than Monday, June 14, 2004, the potential Winner will be required to sign and return a form satisfactory to the Contest Sponsor (a) confirming compliance with the Contest rules and acceptance of the Prize; (b) permitting Contest Sponsor to use the winner’s name, address, photograph and/or video image in any publicity and advertising without compensation, where legal; and (c) releasing Contest Sponsor and the advertising and promotional agencies and the co-ordinating Travel Agency, and their respective agents, officers, directors, employees and representatives from any and all liability, damages, costs, expenses and claims arising out of or relating to the entrant’s participation in this contest or the Prize. In the event that the potential Winner fails to sign such form or obtain such other forms as required above from any Identifiable Individual, he or she will be deemed to have forfeited the Prize, and an alternative potential Winner will be selected. Failure to obtain any forms required by any potential Guest(s) shall not disentitle Winner to Prize but shall prohibit potential Guest from accompanying Winner.

18. For information on the Prize Winner, send a self-addressed, stamped envelope to Loblaws Supermarkets Limited, Photolab “Looks Like Canada Contest”, 6220A Yonge Street, North York, Ontario M2M 3X4. All requests must be received by July 30, 2004.
